1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and PakaPay Ltd ("we," "us," or "our"), concerning your access to and use of the PakaPay website and our digital wallet and transfer platform. By creating an account, depositing funds, or utilizing any services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, please terminate your account session and stop using the services immediately.

2. Account Registration & Eligibility

To register an account, you must be at least 18 years of age (or the age of legal majority in your country of residence). You agree to provide true, accurate, current, and complete details during registration. You are solely responsible for safeguarding your login credentials, API keys, and account sessions. PakaPay will not be held liable for any financial losses arising from unauthorized access to your account due to negligence in keeping your credentials confidential.

3. Wallet Balances & Peer-to-Peer Transfers

Your PakaPay wallet displays simulated and live balances representing fiat currencies.

  • Transaction Finality: All peer-to-peer transfers are processed instantly. Once a transfer is submitted and confirmed, it is final and cannot be reversed or recalled by PakaPay. Ensure the recipient's email details are correct before sending.
  • Limits: PakaPay reserves the right to impose daily and monthly transaction limits on your wallet transfers depending on your compliance verification (KYC) tier status.

4. Settlements & Payout Requests

Standard users can request to withdraw their wallet balances into local bank accounts or mobile wallets. All payout requests are submitted as `pending` and are subject to administrative review. PakaPay reserves the right to hold, reject, or request additional verification documents for payouts that exceed threshold limits or flag internal fraud prevention rules. If a payout is rejected, the corresponding amount is refunded back to the user's wallet.

5. Prohibited Activities

You agree not to use PakaPay for any illegal, fraudulent, or abusive activities. Prohibited behaviors include:

  • Creating multiple accounts to exploit welcome gift balances.
  • Attempting to bypass security barriers or exploit API rate limits.
  • Using the system to launder funds derived from criminal activities.
  • Providing false or misleading KYC documentation.

PakaPay reserves the right to suspend or permanently block accounts found engaging in prohibited activities, and report relevant details to authorities.

6. Limitation of Liability

In no event shall PakaPay Ltd, its directors, employees, or partners be liable for any direct, indirect, incidental, special, or consequential damages resulting from (i) your use or inability to use our platform; (ii) unauthorized access to or alteration of your transactions; or (iii) server down-times, network outages, or hardware failures. PakaPay does not guarantee that the services will operate without interruption or error.

7. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with local financial legislation and banking laws, without regard to conflict of law principles. Any legal actions or disputes arising from these terms shall be settled exclusively in the competent courts of our primary corporate headquarters.

8. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. We will notify users of major updates by posting notices on this page and updating the revision date. Continued usage of PakaPay services following updates indicates your acceptance of the revised terms.
